This Privacy Policy is meant to help you understand what data we collect, why we collect it, and how we deal with it when you visit the Websites and/or use Geek Divers.

Personal data

Personal data means any information relating to an identified or identifiable natural person, e.g. your name, address, telephone number, email address or date of birth. Non-personal data on the other hand are information that cannot be connected to a natural person, e.g. the number of users visiting our website or any other kind of aggregated information.

By clicking on button Login from  www.geekdivers.com homepage you can access Geek Divers login page. You can access our Geek Divers Software as a Service (SaaS) for dive centers and dive resorts only if you have a valid username and password. What data we collect and why we collect it

General Log Files

Whenever the Websites are visited, our web servers automatically collect and store certain information in what is known as log files (the ‘General Log Files’). A General Log File contains only certain data on the hardware of your device. This information will be stored separately and can and will not be combined with personal user data (such as data on your Geek Divers account et al.). We merely use the General Log File in order to better analyse cases of disturbance in the availability of our server. The data from the General Log File will be deleted after twelve months.

Extended Log Files

We will log the traffic volume per customer and setup alerts in case of malfunctioning of the application. We will not delete these anonymized data in order to provide the best possible service.

We have to log data more extensively in order to

– ensure the continued and best possible operation of Geek Divers for you and to detect and fix any incidents that may be in the way of providing the best possible service for you;

– measure your use of Geek Divers in terms of use intensity.

Google Analytics

We use Google Analytics as a web analytics service on our Websites.

Google Analytics is a web analytics service provided by Google, Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (“Google”). It sets one or more analytics cookie. Google uses such cookies to help us analyze how users use our website and services. The information generated by the cookie(s) about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. The IP address will, however, be truncated and therefore anonymized before transmission. On our behalf Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet activity in connection with the use of the website. Google will not associate your IP address with any other data held by Google.

Payment Services

We will use PayPal to generate invoices for our Geek Divers customers. For this purpose, we will need to provide your e-mail address, your company data and the amount due to PayPal. We do this only for processing the payment. The PayPal service is provided by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. Social Media

We use several ‘Social Plugins’ which enable you to share content directly from our website via various social networks. The social plugins will build a connection between your browser and the social network’s server when you visit our website. You do not need to be logged in or actively open the social network’s website. The provider of the social network will receive the information that you visited our website with your IP-address. If you are logged in to a social network while visiting our website the provider of the social network will be able to match your visit at our website to your account. If you click on a social plugin, the content of our website will be interlinked with your account at the respective social network. Data will be transferred to the USA during this process. Please note that we do not receive any influence or knowledge about the content of the transferred data or its use by the social network.

Contacting us

When you get directly in touch with us through our general contact channels, e.g. via email, via Facebook Messenger, Instagram, WhatsApp or Skype, we will collect and store the data (including personal data) you provide us with during the communication in order to adequately respond to, and further manage, your request. In particular, this may, as applicable, apply to your email address, your name, your query including the information embodied in it.

Registering and logging in

If you request access to Geek Divers as a user, whether for a test/demo account or your business account, you enter into a corresponding contract with us on the use of Geek Divers (Terms & Conditions). You can login to Geek Divers with a username and temporary password that we provide on request. The first time you login you will be guided to change the temporary password and replace it with one of your choice. The new password is encrypted and no one (including us) can read it. In case you forget your password you can click on button ‘Forgot password’ on Geek Divers login page to reset it.

If you request your official Geek Divers business account for your dive center or dive resort, we will create a personal login with full rights (admin) for the dive center Manager/Owner. This login can create additional staff logins with limited access for your staff members.

Registration and login with your e-mail address (Geek Divers App and website)

If you choose to login with your email address we collect and store all data (including personal data), that you provide us with during your request and/or under the Terms & Conditions. This data may, in particular, include your name and email address as well as the password you have chosen (the latter we store in encrypted form only). For invoicing purposes we will also ask you to provide the necessary invoicing information.

Comments on blog.geekdivers.com

When visitors leave comments on the blog we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the Websites, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

Any picture that you upload to your Geek Divers account will be treated confidentially. Only you and your staff members with a login will be granted access with read/write rights.

Newsletter

If you subscribe to Geek Divers newsletter, we will collect the data that you share with us in a protected list in Mailjet. The Geek Divers newsletter contains news and features about Geek Divers and you will receive it every 6-8 weeks or whenever we release a new software version. Cookies

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

If you have an account and you log in to this site, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that request a Geek Divers account, we also store the personal and business information they provide in their user profile. All users can see, edit, or delete their personal and business information at any time (the username cannot be changed). Website administrators can also see and edit that information.

Where we send your data

Visitor comments may be checked through an automated spam detection service.

How we protect your data

If you subscribe to our newsletter, your data will be transferred to our password-protected Mailjet account in our mailing list. If you choose to use our Geek Divers SaaS, your personal and company information together with all your customers and business data will be stored in three secure servers in Europe. We do not disclose your data except:

– if and to the extent necessary for the performance of the contract we have with you or in order to enforce any claims we are entitled to,

– if you have given your consent to such disclosure,

– if we are required by law or ordered by a court to disclose such information.

Contract data

When you contact us, we keep a record of your communication with us in order to help solve the respective issue. For example, we use your email address to send you your account details as well as to later contact you about matters concerning your user account and/or with regard to contractual matters.

We use your email address, in addition to any direct contractual communication we may have with you, to inform you on any new developments regarding your processes in Geek Divers in order to allow you to make full and the best use of Geek Divers and its collaborative elements.

Any optional data you may have uploaded (such as your company logo) will only be used for allowing you to use your user account as desired.

Analytics data

Data we receive as a result of analytics cookies is used for categorical, geographical, and behavioural device and optional site visitor targeting. Data we receive by the use of cookies will also be used in order to operate the Websites and to offer our users an easier possibility to login and to improve your user experience and the overall quality of our services. For the purpose of offering our users a safe and user-friendly service we use such data to learn about how users generally use the Websites and Geek Divers.

Your rights of access

Upon your request we will provide you with confirmation as to whether or not personal data relating to you are being processed and information at least as to the purposes of the processing, the categories of data concerned, and the recipients or categories of recipients to whom the data are disclosed; and/or information on the personal data undergoing processing, and of any available information as to their source.

Further, we will, upon your request, rectify, erase or block all or part of your personal data if the data or, as the case may be, the processing of the data do not comply with the applicable statutory provisions, in particular because of the incomplete or inaccurate nature of the data; and/or notify any third parties to whom your personal data have been disclosed of any rectification, erasure or blocking carried out in compliance with the preceding paragraph, unless this proves impossible or involves a disproportionate effort on our part.

If you have left comments on our blog, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

What data breach procedures we have in place

In case of data breach, we will assess the extent of the damage and promptly inform you in case any of your data has been compromised. We will also work with the German authorities to report the crime and support the investigation.
